Freedom of Expression and Hate Speech on Social Media – St. Thomas Tonight

Protecting freedom of expression and making sure that people are not subject to discrimination or hate. That is the challenge with social media right now.
This evening we talked about the Canadian Charter of Rights and Freedoms and how sections 2 and 15 may impact legislation in relation to social media sites. https://laws-lois.justice.gc.ca/eng/const/page-15.html

Bill C-10 (https://parl.ca/DocumentV…/en/43-2/bill/C-10/first-reading) was also discussed. Dr. Michael Geist, who is an expert in the field of technology law in Canada gives an excellent critique of the bill in this article:

“Bill C-10, An Act to Amend the Broadcasting Act Statement
After studying the Bill, my colleagues in the Conservative Caucus do have concerns with the Bill as it is vague and does not address important aspects of Canadian broadcasting. The Bill does not ensure that web giants such as Google and Facebook must compete under the same rules as Canadian companies or explain how digital platforms and conventional players will compete on an even playing field. C-10 also does not address the issue of proprietary content that is shared on digital platform and does not modernize the copyright law.
My Caucus colleagues and I believe in an even playing field that public policy should consider the ever-changing market and not simply “pass the buck” to the CRTC for every decision who would take months to undertake regulatory phases. Our Caucus is committed to eliminating the Goods and Services Tax (GST) on subscriptions to Canadian digital platforms, thereby promoting online cultural contact by Canadian cultural concerns.”
